As life expectancy increases the onset of dementia and similar chronic problems have become a developing concern.

Unfortunately there are other cases where clients have a lifetime of incapacity.

In circumstances where a person is mentally incapable of dealing with their affairs, those affairs are frozen. This can cause enormous problems.

Those problems can be avoided with the preparation of a Lasting Power of Attorney.

If these documents have been validly executed we can:

    • Advise the attorney what they need to do
    • Assist the attorney with the management of the donor’s affairs
    • Register the Power with the appropriate authorities

 

We are also able to give guidance to the attorneys as to the extent of their duties and how best to carry them out.

If there is no Lasting Power of Attorney then at the time of incapacity the affairs of the Patient will be frozen until a Deputy is appointed by the Office of the Public Guardian.

As a firm, we have over 30 years of experience in this field, and currently have a team of dedicated lawyers experienced in dealing specifically with these matters. The team is headed by John Longworth who was one of six Deputies on the Office of the Public Guardian’s Panel of Deputies in the Greater Manchester area, and the only one in Tameside. John is very highly regarded by the Court of Protection having been appointed to the Panel after the Panel was reduced from 360 Deputies to 60 Deputies nationwide.         • Guide you through the process involved in the appointment of a Deputy
        • Decide who the most appropriate person is to be a Deputy – usually a member of the Patient’s family or other trusted person
        • Advise regarding the management of the Patient’s financial affairs.
        • Advise regarding the management of the Patient’s personal welfare

We currently act in approximately 90 cases for a client as Deputy, and also advise on numerous other cases. We currently hold about 1500 Powers of Attorney made on behalf of our clients.
