Why Does Marriage Cancel My Will?
In England and Wales, marriage or civil partnership usually invalidates any existing Will, unless it was made specifically in contemplation of that marriage.
This means your Will must clearly state your intention to marry a named person.
If it doesn’t, your Will is no longer valid, and you’ll need to create a new one to ensure your wishes are respected.
What If I Don’t Make a New Will?
If you pass away without a valid Will, your estate will be distributed under the rules of intestacy, which may not reflect your personal wishes. These rules:
- Prioritise your spouse and biological/adopted children
- Exclude stepchildren, cohabiting partners, and close friends
- Can lead to unintended consequences or family disputes
As of 2025, your spouse would inherit the first £322,000, all personal belongings, and half of the remaining estate. The rest would go to your children. This can create complications—especially in blended families.
Planning for Blended Families
If you have children from a previous relationship, it’s especially important to update your Will.
Without doing so, your new spouse could inherit everything, unintentionally leaving your children without provision.
