The normal court working environment is unlikely to return until the spring of 2021 according to the President of the Family Division. It is inevitable that social distancing restrictions will remain for several months and as a result many cases will continue to be dealt with remotely. Parties appearing before the court should expect the issues to be limited only to those which it is necessary to determine the disposal of the case. Oral evidence and submissions will be greatly reduced.
The courts will notify the parties which remote platform is to be used at least three days before the hearing. The family courts are currently using the cloud video platform and Microsoft Teams.
Lay parties are also being encouraged to engage in a hearing from a solicitor’s office or barrister’s chambers.
